Rules for use of the WCOE DMV public website and regional digital services.

These Terms of Use (“Terms”) govern access to and use of wcoe-dmv.org and related WCOE DMV regional digital services (collectively, the “Platform”). By using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

The Platform is in an initial launch and stabilization period. Features may be introduced, limited, modified, suspended, or removed as WCOE DMV completes testing, security review, permissions validation, content migration, and operational rollout.

1. WCOE DMV and national membership

WCOE DMV serves the regional DC-Maryland-Virginia WCOE community. National membership eligibility, dues, enrollment, and national member records are handled through WCOE National and its systems. The regional Platform provides local access and services but does not replace National membership systems.

2. Accounts and access

  • Provide accurate information and keep account information reasonably current.
  • Protect your login credentials and do not share an account in a way that defeats intended access controls.
  • Notify WCOE DMV promptly if you suspect unauthorized account access.
  • Use only the access level, company association, and permissions assigned to you.
  • Do not attempt to bypass authentication, authorization, row-level security, rate limits, or other safeguards.

WCOE DMV may approve, deny, suspend, limit, or terminate regional Platform access when reasonably necessary for membership verification, organizational administration, security, misuse prevention, legal compliance, or protection of the Platform and its users.

3. Acceptable use

You may use the Platform for legitimate WCOE, professional networking, business connection, event, resource, and organizational purposes. You may not use the Platform to:

  • break the law, infringe rights, harass others, impersonate another person, or submit knowingly false or misleading information;
  • introduce malware, probe or attack security, interfere with service, or use automated tools to overwhelm or circumvent the Platform;
  • scrape, crawl, bulk harvest, resell, redistribute, or create unauthorized databases from member-only information;
  • use directory or member information for unauthorized mass solicitation, data-broker activity, generalized AI/model training, enrichment, or unrelated commercial databases;
  • copy or exploit protected Platform content or technology beyond the rights granted to you; or
  • use another person’s account or obtain information through access you are not authorized to have.

4. Member, company, and submitted content

You remain responsible for content you submit and represent that you have the rights and authority necessary to provide it. By submitting content for Platform display, you grant WCOE DMV a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, and distribute that content as reasonably necessary for WCOE DMV operations, promotion of the submitted item, archival purposes, and technical delivery through service providers.

This license does not transfer ownership of your underlying content. You may request removal of content you control, subject to reasonable archival, recordkeeping, legal, and operational needs.

5. Intellectual property and Platform technology

WCOE names, logos, trademarks, member materials, and other third-party content remain the property of their respective owners or licensors. The Platform also contains software, architecture, design systems, workflows, methods, and other technology developed or provided by Marketus Aurelius, LLC or third parties. Your use of the Platform does not transfer ownership of those materials or technologies to you.

Nothing in these Terms authorizes users to extract, copy, reverse engineer, resell, or deploy reusable Platform technology outside the ordinary use of WCOE DMV services, except to the extent such restriction is prohibited by law or an applicable open-source license.

6. Third-party services and links

The Platform may rely on or link to third-party services, including national WCOE membership systems, authentication, databases, email, hosting, storage, event registration, payment, social media, maps, or other services. Those services are governed by their own terms and privacy practices. WCOE DMV and Marketus Aurelius, LLC do not control independent third-party services and are not responsible for their separate acts, outages, content, pricing, or policies.

7. Information and availability disclaimer

WCOE DMV works to keep Platform information useful and current, but event details, member profiles, links, sponsorship information, outside opportunities, and other content may change or contain errors. Unless expressly stated otherwise, Platform content is provided for general organizational and informational purposes and is not legal, financial, tax, bonding, procurement, licensing, or other professional advice.

The Platform and its content are provided “as is” and “as available” to the maximum extent permitted by law. WCOE DMV, Marketus Aurelius, LLC, and their respective officers, directors, employees, volunteers, contractors, and service providers disclaim implied warranties of merchantability, fitness for a particular purpose, noninfringement, uninterrupted availability, and error-free operation to the extent such warranties may lawfully be disclaimed.

8. Limitation of liability

To the maximum extent permitted by law, WCOE DMV, Marketus Aurelius, LLC, and their respective officers, directors, employees, volunteers, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, business opportunities, goodwill, or data; or damages arising from third-party services, unauthorized user conduct, or events outside their reasonable control.

To the maximum extent permitted by law, the aggregate liability of WCOE DMV and Marketus Aurelius, LLC to a Platform user for claims arising from use of the Platform will not exceed the greater of (a) the amount the user paid directly for use of the regional Platform during the twelve months before the claim or (b) $100. This limitation does not apply where applicable law does not permit it.

Marketus Aurelius, LLC is an intended third-party beneficiary of Sections 5 through 9 of these Terms and may enforce those provisions to the extent applicable to claims involving its technology or services.

9. Responsibility for misuse and third-party claims

You are responsible for your own misuse of the Platform and for content you submit. To the extent permitted by law, you agree to defend and indemnify WCOE DMV and its service providers, including Marketus Aurelius, LLC, from third-party claims arising from your unlawful use of the Platform, infringement caused by content you supplied, unauthorized harvesting or redistribution of member information, or intentional violation of these Terms. This obligation does not apply to the extent a claim was caused by the protected party’s own willful misconduct or other liability that cannot lawfully be shifted.

10. Changes, suspension, and termination

WCOE DMV may change Platform features or these Terms as the regional service evolves. Material changes will be versioned and may require renewed acceptance for authenticated users. WCOE DMV may suspend or discontinue all or part of the Platform when reasonably necessary, including for maintenance, security, organizational changes, or transition to another provider.

11. Governing law

To the extent permitted by law, these Terms are governed by Maryland law, without regard to conflict-of-law rules. Nothing in these Terms limits rights or remedies that cannot lawfully be waived.
